What is Surrogacy in Delhi?

Surrogacy is the method or process in which a third party i.e. surrogate mother, agrees to carry a child in her womb and go through the pregnancy process for another couple. What are the Types of Surrogacy in Delhi?

There are mainly four types of surrogacy. Out of which, commercial type is banned in India. Here, are the:

An embryo is created through IVF(In Vitro Fertilization) by using the intended couple’s egg and sperm. However, if required egg or sperm from the donor can be used. Later on, an embryo is then placed directly into the surrogate mother’s uterus which leads to pregnancy. 

  1. Altruistic Surrogacy: In this form of surrogacy, 

The surrogate mother will not be compensated for her service of carrying the child in her womb, the risk of pregnancy, the effort, and her time for the process. 

However, she will be compensated for all the medical bills, pregnancy care & needs, insurance, etc by the intended couple. For this type of surrogacy, she must be a close relative of the intended couple and she must be willingly doing this, not for compensation or monetary purposes.

  1. Commercial Surrogacy: This type of surrogacy is completely banned in India now after the Surrogacy (Regulation) Act of 2021. It is because, in this, the surrogate mother was usually getting paid for her service of carrying the baby for the intended couples. It is illegal to practice this now. Hospitals and surrogacy agencies are usually avoiding this type of surrogacy due to further legal allegations and court procedures. 

General Information: Surrogacy (Regulation) Act, 2021 in India?

According to Surrogacy (Regulation) Act, 2021 has some new law amendments in order to allow more people to access surrogacy in India, which are:

  1. Commercial surrogacy is banned in India, Altruistic type will only be practiced i.e. surrogate mothers will only be compensated with medical bills, pregnancy care & needs, and insurance coverage. 
  2. A single woman such as divorced or widowed is allowed for surrogacy in India but she should be between the ages of 35-45 years.
  3. The surrogate should have Indian nationality and she must have to obtain the eligibility certificate from the appropriate authority. 
  4. Using of donor egg or sperm if certain medical conditions of the intended couples are met.
  5. The intended couples must be an Indian nationality as foreign nationals are banned from surrogacy in India.
  6. Only ART Level 2 registered clinics can perform surrogacy.
  7. Single men are not allowed for surrogacy in India.

Commercial surrogacy is banned in India now as it could lead to the exploitation of the surrogacy industry in India. The government came forward after hearing many cases of unethical practices and exploitation of poor surrogate mothers from mainly rural areas. For this, cases such as child trafficking also increased in the country. 

Can Single Woman Opt for Surrogacy in Delhi?

Yes, single woman can opt for surrogacy in India. According to Surrogacy (Regulation) Act, 2021, the Central government has allowed single woman for surrogacy centre Delhi. She can only use self-egg and donor sperm for the surrogacy process in India.
